1. Introduction
Welcome to CentralCooperativeHub ("we," "us," or "our"). The following Terms & Conditions ("Terms") are set to regulate your usage of our yacht charter services and our platform located at centralcooperativehub.sbs, which is managed by CentralCooperativeHub.
Your agreement to these Terms is necessary when you book a charter or use our Service. Should you not agree with any part of the terms herein, you should refrain from using the Service.
2. Service Overview
At CentralCooperativeHub, we offer exclusive yacht charter services which include, but are not limited to:
- Daily yacht charters
- Evening sailing experiences
- Business team-building excursions
- Exclusive gatherings
- Extended yacht excursions
All offerings depend on availability and can be influenced by weather conditions. We maintain the right to adapt or terminate services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Requirements for securing a charter are as follows:
- A minimum age of 18 years
- Supplying accurate and complete details
- Making a deposit as outlined in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
We only confirm bookings on successful payment and subsequent written confirmation. We reserve the full right to deny our services to anyone as we see fit.
3.3 Availability
Each charter is contingent on the availability of vessels and favorable weather conditions. We will commit reasonable effort to meet your scheduling preferences.
4. Payment Terms
4.1 Pricing
All service quotes are in € and include applicable taxes, unless specified differently. Prices can change without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost is required at the time of booking
- Balance: The remainder is due 48 hours in advance of the charter departure
- Any additional fees: Payable at the close of the charter
4.3 Payment Methods
We accept most major credit cards, wire transfers, and certified cheques. All payments are securely processed through encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Full refund minus processing fees
- If canceled 24 to 72 hours before departure: 50% refund
- If canceled less than 24 hours before departure: No refund
5.2 Weather Cancellations
In the case of unsafe weather as determined by our captain, options include:
- Rescheduling your charter at no additional cost to the next available slot
- Offering a full refund when rescheduling is not a feasible option
5.3 Mechanical Issues
Should your vessel face mechanical failures, we will strive to provide a comparable alternative. Should we fail to do so, a full refund will be furnished.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Comply with instructions from the crew
- Utilize safety gear as stipulated
- Reveal any medical conditions that could affect their well-being during the charter
- Stay within the designated areas aboard the vessel
6.2 Prohibited Items
Certain items are strictly prohibited on our vessels:
- Glassware
- Illegal substances
- Weapons of any kind
- Excessive amounts of beverages (only reasonable quantities allowed)
- Animals (except with prior consent)
6.3 Conduct
Passengers must behave respectfully at all times. If conduct threatens safety or disrupts others' experiences, we may cut the charter short without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
We hold responsibility only up to the amount you have paid for your charter. We are not liable for:
- Injuries due to passenger negligence
- Loss or damage to personal belongings
- Indirect, consequential, or punitive damages
- Delays from weather or events out of our control
7.2 Insurance Coverage
We ensure complete marine insurance for our vessels and operations. Travel and personal insurance is the passengers’ own responsibility.
7.3 Assumption of Risk
By taking part in our charter services, you accept that maritime activities carry inherent risks and you take on the accountability for your own safety.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, courses, or schedules subject to weather, safety needs, or operational demands. We will endeavor to give similar alternatives where necessary.
9. Force Majeure
We can’t be held accountable for any delays, cancellations, or changes brought about by unforeseen forces or events beyond our command, which include but aren't limited to:
- Extreme weather events
- Natural calamities
- Regulations by authorities
- Seaport closures
- Vessel malfunctions
10. Privacy and Data Protection
We handle your private data in line with our Privacy Policy. Engaging with our services shows your consent to our collection and use of your information as revealed in the Privacy Policy.
11. Intellectual Property
All contents of our website such as text, images, and logos are protected by copyright and may not be replicated, circulated, or adapted without our explicit consent.
12. Governing Law
These Terms are under the jurisdiction of the law within Germany. Any disputes will be addressed in the courts situated in Hamburg, Germany.
13. Changes to Terms
We reserve the authority to adjust these Terms as necessary. Updates will be posted to our website and will include the date of revision. Using our services after changes have been implemented indicates your agreement to the new terms.
